Probate is the court procedure for proving the validity of a Will and appointing the estate trustee. It involves an application to the Court wherein the Court reviews the Will and confirms that it satisfies all formal requirements. Once the Court is satisfied with the validity of the Will and certain other requirements, it issues a Certificate of Appointment of Estate Trustee with a Will. If there is no Will, there are other steps to be taken which will result in the issuance of a Certificate of Appointment of Estate Trustee Without a Will.
